Please read these Terms of Use ("Terms") carefully before using the Gita Talk mobile application (the "App") operated by Gita Talk ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Eligibility

You must be at least 13 years of age (or 16 years of age if you are located in the European Economic Area) to use Gita Talk. By using the App, you represent and warrant that you meet the applicable age requirement.

If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To use Gita Talk, you must create an account by signing in with Apple or Google. You are responsible for:

  • Providing accurate and complete information during registration.
  • Maintaining the security of your account credentials.
  • All activity that occurs under your account.

You may not share your account with others or use another person's account without their permission. If you believe your account has been compromised, please contact us immediately at support@gitatalk.app.

3. Description of Service

Gita Talk is a spiritual companion app that provides AI-generated responses grounded in the wisdom of the Bhagavad Gita. The App allows you to:

  • Engage in conversations with an AI companion ("Gita") based on the Bhagavad Gita.
  • Explore a Feeling Map with curated verses relevant to your emotional state.
  • Maintain a streak and conversation history.
  • Optionally write private journal entries with AI-assisted reflections.
  • Receive optional push notification reminders.

4. Not a Mental Health or Medical Service

IMPORTANT: Gita Talk is a spiritual companion app and is NOT a mental health service, therapy service, crisis service, or medical service. The AI-generated responses provided by the App:

  • Are not professional mental health advice, therapy, or counseling.
  • Are not medical advice or diagnosis.
  • Are not a substitute for professional mental health care.
  • Should not be relied upon in a mental health emergency or crisis.

If you are experiencing thoughts of self-harm, suicide, or a mental health emergency, please immediately contact a qualified mental health professional or a crisis service. In the United States, call or text 988 (Suicide and Crisis Lifeline) or text HOME to 741741 (Crisis Text Line). In an emergency, call 911 or your local emergency services.

By using the App, you acknowledge and agree that Gita Talk is not a mental health provider and that you will seek appropriate professional help when needed.

5. Subscriptions and Payments

5.1 Free and Paid Access

Gita Talk offers a limited number of free messages per period. To access unlimited messages and all features, a paid subscription is required.

5.2 Subscription Plans

Subscription plans and pricing are displayed within the App. We currently offer:

  • Monthly subscription: billed monthly.
  • Annual subscription: billed annually, with an optional free trial period as described at the time of purchase.

5.3 Free Trial

If a free trial is offered, you may use the App's paid features for the trial period at no charge. At the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends.

5.4 Billing and Renewal

All subscriptions are processed through Apple's App Store In-App Purchase system. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period.

5.5 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by applicable law.

5.6 Price Changes

We reserve the right to change subscription prices. We will provide reasonable advance notice of any price changes. Your continued use of the App after a price change takes effect constitutes your agreement to the new price.

6. Acceptable Use

You agree to use Gita Talk only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the App for any purpose that is illegal, harmful, or fraudulent.
  • Attempt to gain unauthorized access to the App or its servers.
  • Reverse engineer, decompile, or otherwise attempt to derive the source code of the App.
  • Use the App to harass, abuse, or harm others.
  • Submit false or misleading information.
  • Use automated means (bots, scrapers) to access the App.
  • Attempt to probe, scan, or test the vulnerability of any system or network.
  • Interfere with or disrupt the integrity or performance of the App.

We reserve the right to terminate or suspend your account if you violate these Terms.

7. Intellectual Property

7.1 Our Content

The App, including its design, code, text, graphics, user interface, and AI-generated responses, is owned by or licensed to Gita Talk and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

7.2 Your Content

You retain ownership of the content you create within the App, including your conversation messages and journal entries. By using the App, you grant us a limited, non-exclusive license to process and store your content solely to provide the App's services to you.

7.3 The Bhagavad Gita

The Bhagavad Gita is a public domain text. Our curation, selection, and AI-assisted interpretation of its teachings are our own work. We do not claim ownership of the original text.

8. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://gitatalk.app/privacy and within the App. By using the App, you agree to the collection and use of your information as described in the Privacy Policy.

9. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be available without interruption or error.
  • AI-generated responses will be accurate, complete, or appropriate for your specific situation.
  • The App will meet your requirements or expectations.

AI-generated responses reflect the output of a language model and may occasionally be inaccurate, incomplete, or contextually inappropriate. Gita's responses are not verified by human experts. Use your own judgment when receiving and acting on any response within the App.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GITA TALK, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Gita Talk and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any applicable law or third-party rights.

12. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.

You may delete your account at any time through the App's Settings. Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including Sections 7, 9, 10, 11, and 13.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misappropriation of intellectual property.

CLASS ACTION WAIVER: YOU AND GITA TALK AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

14. Apple App Store Additional Terms

The following additional terms apply to your use of the App obtained through the Apple App Store:

  • These Terms are between you and Gita Talk only, not with Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, paid for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by email before the changes take effect. Your continued use of the App after the updated Terms take effect constitutes your agreement to the new Terms.
